PRAYER: Criminal Miscellaneous Petition is filed under Section 528 of BNSS, 2023, to permit the petitioners to withdraw the 25% of arrear maintenance amount deposited by the respondent in M.C.No.28 of 2021 on the file of Family Court, Srivilliputhur as per the order of this Court dated 10.07.2025 in Crl.R.C.(MD)No.1273 of 2024. O R D E R

This Criminal Miscellaneous Application is filed by the applicants, who are the Respondents in the Criminal Revision Case, to permit them to withdraw 25% of arrears of maintenance amount, which was already deposited by the Revision Petitioner before the trial Court. 2.Heard Mr.T.Veldurai, learned Counsel for the applicants and Mr.A.K.Manikkam, learned Counsel for the respondent/Revision Petitioner.

3.Mr.T.Veldurai, learned Counsel for the applicants submits that in compliance with the order passed by the Co-ordinate Bench of this Court, dated 10.07.2025, the Revision Petitioner viz., Manikandan, has 2/5

deposited 25% of the arrears of maintenance amount to the credit of M.C.No.28 of 2021 on the file of Family Court, Srivillliputhur. He further submits that the applicant may be permitted to withdraw 25% of the arrears of maintenance amount, which was already deposited by the Revision Petitioner before the trial Court.

4.Accordingly, after considering the arguments as advanced by the learned Counsel for the parties, the first applicant viz., Sanmathi Iswarya, is permitted to file an application before the Family Court, Srivilliputhur, for withdrawal of 25% of the arrears of maintenance amount, which was already deposited by the Revision Petitioner to the credit of M.C.No.28 of 2021 on the file of Family Court, Srivillliputhur. within a period of ten days from today and if any such application is filed by the first applicant viz., Sanmathi Iswarya, within the time stipulated by this Court, the learned Judge, Family Court, Srivilliputhur, is directed to disburse the said amount to the first applicant viz., Sanmathi Iswarya within a period of ten days thereafter.
