Respondents (R - 4 is impleaded as per the order dated 08.12.2014 made in M.P(MD)No.1 of 2014) (R 4 to R 10 deleted vide order, dated 07.11.2014) Habeas Corpus Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus to direct the respondents to produce the person or body of the petitioner's husband the detenu namely Zahir Hussain, aged about 40 years before this Court and set him at liberty.

ORDER
(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner is the wife of one Mr.Zahir Hussain. According to her, he has been found missing from the month of February 2013. In this regard, she made a complaint to the Superintendent of Police, Pudukottai, https://hcservices.ecourts.gov.in/hcservices/
but no action was taken to secure Mr.Zahir Hussain. With that grievance, the petitioner filed the present Habeas Corpus Petition seeking a direction to the respondents to cause the production of Mr.Zahir Hussain before this Court and set him at liberty.
2. We have heard the learned counsel for the petitioner, the learned Additional Public Prosecutor for the respondents and we have also perused the records carefully.
3. The learned Additional Public Prosecutor would submit that it is true that Mr.Zahir Hussain is missing and the CBCID police has registered a case in Crime No.1 of 2015 for offence under Section 365 IPC in respect of the said occurrence and the same is under investigation. Therefore, in our considered opinion, there will be no purpose served by keeping this Habeas Corpus Petition pending. If the petitioner has got any grievance regarding the investigation, she is at liberty to work out her remedy in accordance with law. Accordingly, the Habeas Corpus Petition is closed.
