ORDER

This writ petition has been filed for a writ of Mandamus, to direct the respondents 1 and 2 to disburse the missing credits in her contributory pension to the tune of Rs.23,36,466/- without insisting for undertaking within the time period stipulated by this Court.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner sought for a positive mandamus, to consider her representation made on 20.08.2024. By a communication dated 27.09.2024, it is seen that the first respondent had authorised the second respondent to disburse the contributory pension to the tune of Rs.23,36,466/-, however, on an undertaking given by the petitioner that she will not make any further claim. The petitioner had also made an objection on 29.12.2024 indicating that the CPS benefits has not properly been accounted for and there are certain missing credits, for which she is be entitled to claim. Such objection should be considered by the respondents.

In view of the admitted position, the second respondent is directed to disburse the contributory pension to the tune of Rs.23,36,466/- within a period of six weeks from the date of receipt of a copy of this order and the first respondent is also further directed to consider the objections made by the petitioner, dated 29.12.2024 and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition stands disposed of. No order as to costs.
