PRAYER: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to sponsor the Petitioner's name for the post of B.T. Assistant and consequently direct the 1st respondent to give suitable instructions to the recruiting agencies to treat the degree B.Ed., (Special Education) at equivalent to B.Ed., Regular Education for appointment in all the posts in the forthcoming vacancies and thereby consider the Petitioner's name for appointment to the said post within the time limit that may be stipulated by this Court. The relief sought for in this writ petition to direct the 2nd respondent to sponsor the petitioner's name for the post of B.T. Assistant.
2.The very relief, as such, sought for in this writ petition cannot be granted now, in view of the fact that the appointment to the post of B.T. Assistant has to be undertaken only through the Teachers Recruitment Board and in accordance with the recruitment rules in force. The appointment has to be made only by following the recruitment rules in force and there cannot be any consideration for issuing any such direction for sponsoring the name of the writ petitioner. sought for cannot be granted and it is left open to the writ petitioner to submit an application if any notification is issued and participate in the process of selection by putting hard work. 3.Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs.
