ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus directing the 2nd respondent to consider the petitioner's representation dated 10.10.2025 and to pass orders forthwith for dissolving the unregistered Chit Fund Scheme said to be run in the name of "The Senai Thalaivar Community Society, Veeravanallur, Tirunelveli District".

2. The petitioner states that he is a member of the Senai Thalaivar Community Society, which consists of around 600 members. According to the petitioner, the society has no valid registration and the so-called office bearers are only "letter-pad office bearers". It is further alleged that the President has appointed himself and others without proper election or 2/6

authorization and that, in spite of having no registration, the society has started collecting money from the public under the guise of a chit fund scheme.

3. The petitioner submits that this amounts to violation of the provisions of law governing chit funds and societies. It is stated that several members of the public, including the petitioner, have raised objections and issued legal notices and representations to the authorities. However, no action has been taken by the official respondents to regulate or dissolve the chit scheme allegedly conducted by the 5th respondent. It is further alleged that the 5th respondent has been threatening the petitioner for questioning such activities. The petitioner, therefore, made a representation dated 10.10.2025 seeking appropriate action. Since no steps were taken, the present writ petition has been filed.

Mr.D.Sasikumar, learned Additional Government Pleader, on instructions, submits that the District Registrar, Societies Registration, Tirunelveli, is the competent authority to examine the grievances raised by the petitioner. However, the petitioner has not arrayed the said authority as a respondent.

5. In view of the above submission, the District Registrar, Societies Registration, Tirunelveli, is suo motu impleaded as the 6th respondent. The 3/6

petitioner is directed to forward a copy of the representation dated 10.10.2025 to the newly impleaded respondent within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the same, the 6th respondent shall consider the petitioner's representation and pass final orders on its own merits and in accordance with law within a period of two months thereafter. The 6th respondent shall bear in mind that the seriousness of the allegations, if proved true, would amount to cheating gullible persons and scamming them of their hard-earned money. The 6th respondent shall not only hear the petitioner but also the persons who have subscribed to the chits, as well as those who claim to be the office-bearers of the society concerned.
