Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to call for the records pertaining to the impugned order dated 16.09.2025 in No.4165/O/2025 passed by the 3rd respondent quash the same and consequently directing the respondents 1 to 4 take action as against the respondents 5 and 6 for the forged Settlement Deed executed by the 5th respondent in favour of 6th respondent vide in Document No.949/2011 dated 22.03.2011 by concealment of facts by the respondents 5 and 6.

ORDER

Heard the learned counsel for the writ petitioner and the learned Additional Government Pleader for R1 to R4. Issuance of notice of R5 & R6 is dispensed with.

2. The petitioner feels aggrieved by the execution of the settlement deed dated 22.03.2011 by the fifth respondent in favour of the sixth respondent. According to the petitioner, tracing of title by the fifth respondent is fraudulent. For this, the petitioner seeks action to be initiated under Section 83 & 84 of the Registration Act.

3. It is well settled that this penal provision can be invoked only if during enquiry any false statement has been made. The incorporation of a wrong recital in the document of conveyance will not attract the aforesaid provision. The petitioner's remedy is only before the jurisdictional Civil Court.

3. The Writ Petition is dismissed. No costs.
