O R D E R

This writ petition is filed for a mandamus to direct the first respondent to issue legal heir certificate to the petitioner based on her representation dated 13.02.2025.

2.It is the case of the petitioner that the petitioner got married to deceased Nagarajan on 03.02.2016 after the death of his first wife on 12.11.2015. The petitioner's husband died on 07.05.2024. Thereafter, she made an application before the first respondent seeking legal heir certificate by paying requisite fee. The petitioner was called for enquiry and directed to file some documents. The petitioner has also submitted the required documents. While so, the first respondent, without any notice to the petitioner, has rejected the application of petitioner on 10.04.2025 on the basis of the objections raised by the fourth respondent claiming herself as a legal heir of the deceased Nagarajan. 3.Perusal of the impugned order shows that the same has been passed without affording an opportunity to the petitioner to substantiate the fact that she is the legally wedded wife of the deceased Nagarajan. Therefore, the ground on which the application has been rejected is per se erroneous. Therefore, the impugned order is set aside and the matter is remitted back to the first 2/4

respondent, who shall consider the documents submitted by the petitioner, which would show that she is the surviving and legally wedded wife of the deceased Nagarajan and pass appropriate orders granting legal heirship certificate. The said exercise shall be completed within a period of two months from the date of receipt of a copy of this order. The orders shall be passed after hearing both the petitioner and the fourth respondent. 4.Accordingly, this writ petition is disposed of.
