Respondents Habeas Corpus Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus to direct the respondents 1 to 3 to produce the body or person of the petitioner's son namely Balakrishnan aged 28, before this Court and set him at liberty. ORDER

(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner has come up with this petition alleging that his son by name Balakrishnan, aged 28 years, has been found missing from the month of February 2009. In connection with the same, a case has been registered in Crime No.457 of 2010 on 03.10.2010 and the investigation is in progress. Since the missing man has not been rescued, the petitioner has come up with this petition.

2. We have heard the learned counsel on either side and also perused the records carefully.

3. The learned Additional Public Prosecutor would submit that more than 125 witnesses have been examined so far. Even then, whereabouts of the detenu has not been known to anybody. The said statement is recorded.

4. In view of the above, no purpose would be served by keeping the Habeas Corpus Petition pending. Accordingly, this petition is disposed of with a direction to the respondent police to expedite the investigation.
