ORDER
This writ petition has been filed seeking for a direction to the respondents 1 and 2 to issue an appointment order to the petitioner based on the first respondent's proceedings vide Na.Ka.Na.2/20132/2009 dated 02.02.2015.

The petitioner claims that despite having been appointed by the first respondent by its order dated 02.02.2015, having been called upon to produce the certificates by the second respondent, which has also been produced by the petitioner, no posting order has been issued to the petitioner, on the pretext that the petitioner did not submit the application within a period of three years from the death of the deceased employee.
3. The respondents/Government claims that eventhough an application had been filed by the deceased employee's wife/petitioner seeking compassionate appointment for the elder daughter, the 2/5
petitioner's application had been received only after the period of three years from the date of the deceased's death.

It is to be noted that the petitioner had been substituted in place of the elder daughter and after due consideration of the application submitted by the petitioner, the first respondent issued the appointment order as early as 02.02.2015, also allotting her to the Research Division, Chennai. However, the second respondent had called upon the petitioner to produce the documents, which have also been produced. When the appointing authority himself has decided the application of the petitioner granting appointment to her elder daughter, again calling upon the petitioner to submit the documents is in violation of the Rules.
5. For the simple reason that the application of the petitioner had been belatedly given, the subordinates of the first respondent had not issued appointing order to the petitioner. Such conduct of the respondents 2 and 3 is nothing but insubordination. 3/5
6. In view of the above, the first respondent is directed to consider the matter and issue necessary posting order to the petitioner. Accordingly, this writ petition is allowed. No Costs. 10.11.2025 tta TO
