ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent to conduct an enquiry to correct the revenue records relating to the extent of the property in Survey No.155, situated at Vilathikulam Taluk, Vembar Village, Thoothukudi District, based on the petitioner's representation dated 30.08.2025, and to survey the property in Survey No.155/1B, measuring 1.38.00 Hectares in Patta No.1239, and conclude the same within a time frame to be fixed by this Court.

The learned counsel for the petitioner submits that the petitioner is the absolute owner of the subject property and that the revenue records relating to the property in Survey No.155, Vilathikulam Taluk, Vembar Village, Thoothukudi District, are incorrect. Therefore, the petitioner has made a representation dated 30.08.2025 requesting correction of the records and a survey of the property in Survey No.155/1B, measuring 1.38.00 Hectares in Patta No.1239. Since the same

has not been considered so far, the petitioner has filed the present Writ Petition seeking a direction to the second respondent to conduct the enquiry and survey and to conclude the same within a time frame fixed by this Court.

The learned counsel appearing for the fourth respondent submitted that a survey of the subject property was already conducted on 21.11.2024, and by suppressing this material fact, the petitioner submitted the representation dated 30.08.2025, requesting a survey and has filed the present Writ Petition.

4. The learned Government Advocate appearing for the respondents 1 to 3 submitted that the second respondent requires twelve weeks to complete the enquiry and pass orders in accordance with law, after affording sufficient opportunity to all stakeholders.

Recording the aforesaid submission and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to conduct an enquiry on the representation of the petitioner dated 30.08.2025 and pass appropriate orders on merits and in accordance with

law, after providing reasonable opportunity during such enquiry to the petitioner, the fourth respondent and also any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. Needless to state that in the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
