ORDER

The petitioner seeks a Writ of Mandamus to direct the respondents 1 to 3 to direct the respondents 4 and 5 to conduct an enquiry based on the petitioner's representation dated 08.10.2025.

2. The learned counsel for the petitioner would submit that the Deputy Superintendent of Police, Kodaikanal had found that the pathway dispute between the petitioner and the sixth respondent is leading to breach of peace and had requested the Revenue Divisional Officer to take action.

3. The learned Additional Public Prosecutor however would submit that the petitioner's representation was considered and the same was closed as it discloses only a civil dispute.

4. The Executive Magistrate is not a party to this Writ Petition. In any case, it is not the prayer of the petitioner that the Executive Magistrate should 2/5

conduct an enquiry in terms of Section 164 of BNSS. Based on the petitioner's representation, enquiry has been conducted and concluded by the respondent Police. The respondent Police shall communicate the result of the enquiry to the petitioner forthwith. If the petitioner is aggrieved by the same, it is open to him to seek appropriate remedy in the manner known to law. It is needless to say that the petitioner can also approach the Civil Court.

5. With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs.
