ORDER

This Criminal Original Petition is filed to direct the first respondent to appoint competent investigating officer other than the second respondent to investigate the case in Cr.No.591/2025 on the file of the second respondent for fair and proper investigation.

2. The learned counsel for the petitioner submitted that the petitioner is the de-facto complainant on whose instance, a criminal case in Crime No.591 of 2025 was registered for the offence under Section 194 BNS, 2023 with respect to the suspicious death of her husband which is suspected to have committed by her husband's friends namely Loordhu Michelson, Velappan, Ponmani, Dinesh Babu, Manoj Akash, Aathi and Manosanjay. Since there is no progress in the investigation, this Criminal Original Petition came to be filed.

3. Learned Government Advocate (Crl.side) submitted that investigation has been conducted in this case and the Section has been altered into Section 105 of BNS. After completed the investigation, charge sheet has been filed before the learned Judicial Magistrate, 2/4

Boothapandi, through e-filing in LTN2022000234 C202500740, on 01.12.2025, arraying one Velappan as accused.

4. Heard either side and perused the materials available on record.

5. In view of the submission made by the learned Government Advocate (Crl.side) that investigation has been completed and final report has been filed, if the petitioner is not satisfied with the investigation which is conducted by the second respondent police and with respect to the final report which has been filed by arraying one Velappan as an accused, the petitioner is at liberty to file a protest petition before the learned Trial Court.

6. With the above direction, this Crimnal Original Petition is disposed of.
