J U D G M E N T

When the matter is taken up for hearing today, on the side of the appellant, it is stated that the dispute between the parties is amicably settled out of Court. He has also made an endorsement to that effect.

2. In view of the above submission and the endorsement made by the learned counsel for the appellant, nothing survives for adjudication in this appeal. Therefore, the Second Appeal is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition is also closed.
