Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents herein to give notional promotion Sub Inspector Grade1 /Security with effect from the date on par with his collegues and juniors were promoted i.e. from 2004 on wards taking in account of the modification of the punishment made in the order of appeal dated 19/02/2007 and to pass any order which is deem to fit in the facts and circumstances of the case and thus render justice.(prayer amended vide order dt.09/04/2012 in MP.2/2011). ORDER

The petitioner has filed this writ petition seeking a direction, directing the respondents herein to give notional promotion Sub Inspector Grade-1 /Security with effect from the date on par with his collegues and juniors were promoted i.e. from 2004 on wards taking in account of the modification of the punishment made in the order of appeal dated 19/02/2007. 2.Heard the submissions made on either side and perused the records carefully.

3.The case of the petitioner is that on account of a charge-memo issued against him on 01.09.2003, he is deprived of his service benefits. In this regard, he has submitted several representations from the year 2006 to the respondents. But, sofar, they have not been considered. Hence, he has approached this Court.

4.In view of the above, the respondents are directed to consider the petitioner's representation dated 26.11.2010 and pass orders on the same in accordance with law, after providing an opportunity of personal hearing to the petitioner within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is also disposed of.
