Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of declaration to declare the Advertisement No.R83/MKU/2010 published in "The Hindu" dated 28.12.2010 by the respondent No.3 and 4 as ultra vires of the constitution as violative of Article 14 and 16 and consequently directing the respondents 1 and 2 to de reserve the same post from communal reservation on the basis of the Hon'ble Supreme Court judgment in Devadasan Case and Chakradhar Paswan v. State of Bihar reported in (1988) 2 SCC 214.

The relief sought for in this writ petition is for a declaration to declare the Advertisement No.R83/MKU/2010 published in 'The Hindu' dated 28.12.2010 by the third respondent is void and ultravires of the Constitution.

2. The learned counsel appearing on behalf of the University brought to the notice of this Court that the writ petitioner had applied for the post of Associate Professor (in the Department of Art History, Aesthetics and Fine Arts). However, the post of Associate Professor has not been filled up so far and accordingly, the advertisement under challenge had not acted upon in respect of the Associate Professor in the Department of Art History, Aesthetics and Fine Arts. Therefore, further adjudication in this writ petition is unnecessary, when the post in which the writ petitioner has applied for has not been filed up. The University has to take a decision and issue appropriate fresh notification calling applications from the eligible candidates to fill up the said post.
3. In this view of the matter, no further adjudication is required in this writ petition. Accordingly, the writ petition stands closed. No costs. Consequently, the connected Miscellaneous Petition 1 of 2011 is closed.
