Respondents PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 and 2 to take necessary steps to prevent the 5th respondent from erecting Wind Mills in and around Madathupatti Village and Thiruvattanallur Village, Sankarankovil Taluk, Thirnelveli District.

ORDER

The petitioner has come up with the present Writ Petition for issuing a Writ of Mandamus directing the respondents 1 and 2 to take necessary steps to prevent the 5th respondent from erecting Wind Mills in and around Madathupatti Village and Thiruvattanallur Village, Sankarankovil Taluk, Thirnelveli District.

2. Heard Mr.M.Thirunavukkarasu, learned counsel appearing for the petitioner, Mr.G.Muthukannan, learned Government Advocate appearing for respondents 1 and 2, Mr.P.Thilakkumar, learned counsel appearing for fourth respondent and Mr.S.Murugan, learned counsel appearing for fifth respondent.

3. The learned counsels appearing for the respondents submitted that the fifth respondent has not erected any wind mill in the village of the petitioner and there is no proposal as on date.

4. In the light of the above said submission, no further adjudication is necessary in this petition. Hence, the Writ Petition is closed. No costs.

Consequently, connected Miscellaneous Petition is closed.
