ORDER

This Criminal Original Petition is filed seeking to quash the FIR in Crime No.439 of 2025, on the file of the first respondent police, which was registered for the offences under Sections 296(b) and 131 of BNS. 2.The allegation in the FIR is that the petitioners are tenants in the second respondent's house; that the second respondent insisted the petitioners that they should not park the cycle in the pathway, for which, the petitioners abused the second respondent in filthy language, assaulted him with hands and thus, committed the aforesaid offences.

The learned counsel for the petitioners and the learned counsel for the defacto complainant/the second respondent would submit that the parties have now entered into a compromise on the advise of the elders and well-wishers and both the parties have agreed that the impugned F.I.R may be quashed and the parties have also filed a joint compromise memo dated 17.10.2025.

4.The petitioners, namely, Thajnisha(Aadhaar No.4610 2209 6485), Mubarak @ Kamurudeen (Aadhaar No.3250 1112 267) and the 2/5

second respondent, namely, Mohamed Anjar (Aadhaar No.7950 6115 4541) are present before this Court in person. They are identified by Ms.Muthulakshmi, Head Constable, Tamil University Police Station, Thanjavur District. All the parties confirmed the compromise arrived at between them.

5.Considering the fact that the dispute is between the landlord and tenants and the parties have arrived at a compromise, this Court is of the view that no useful purpose would be served in keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No. 439 of 2025 is quashed and the Criminal Original Petition stands allowed. The petitioners shall pay a sum of Rs.5000/- (Rupees Five Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
