PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Respondents herein to survey the land in Survey field No.112/44 at Madurai District, Peraiyur Taluk, Goundanpatti Bit No.I.

ORDER

By asserting that the land in S.No.112/44 originally belonged to the petitioner's father Murugan and that the petitioner and the other legal heirs of Murugan inherited the property upon his death, the petitioner had applied for a survey of the land.

2. Learned Government Advocate accepts notice for all the respondents. He submits that the petitioner's application would be acted upon after issuing notice to the other legal heirs of late Murugan and the owners of relevant adjacent lands.

3. Learned counsel for the petitioner has placed on record the patta in the name of the petitioner's father. The legal heirship certificate indicates the names of M.Lakshmi, M.Jeyarani/petitioner and M.Balamurugan. Therefore, it is necessary to issue notice to the other legal heirs and to the owners of relevant adjacent lands.

4. Therefore, this writ petition is disposed of by directing the first and second respondent to initiate action on the petitioner's application for survey after issuing notice to all the legal heirs of the late Murugan and to the owners of relevant adjacent lands. Objections, if any, from the said persons shall be 2/4

taken into account before a decision is taken. The entire process shall be concluded within three months from the date of receipt of a copy of this order. No costs.
