ORDER

This writ petition has been filed seeking for a Mandamus directing the second respondent to forthwith disburse the death claim amount payable under policy No.748157585 subscribed by the deceased Tmt.Kanmani Priya in favour of the petitioner, being her only surviving legal heir based on the petitioner's representation dated 23.07.2025 within a time frame to be stipulated by this Court.

2. It is the case of the petitioner that her daughter namely Kanmani Priya passed away on 13.07.2023 in a road accident. The third respondent is the petitioner's son-in-law. There is no issue to the petitioner's daughter and the third respondent. After the demise of the petitioner's daughter, the petitioner came to know that her daughter subscribed LIC policy and nominated her father, Marimuthu, as nominee to the said policy. However, he passed away on 30.09.2019. Therefore, the petitioner and the third respondent are the legal heirs of the deceased Kanmani Priya. Since the third respondent has no objection for the petitioner to receive the motor accident claim and other 2/5

monetary benefits by the petitioner, the petitioner approached the second respondent requesting to disburse of her daughter's death claim under the said policy, along with all the necessary documents including the NOC from the third respondent. However, there was no progress. Hence, the petitioner is before this Court.

3. When the matter came up for hearing, it was once again informed that no objection has been given by the third respondent to the petitioner receiving the compensation and No Objection Certificate to this effect is also given.

4. In the light of the above, the second respondent shall disburse the death claim amount payable in policy No.748157585 in favour of the petitioner within a period of four weeks from the date of production of the copy of this order.
