The petitioner asserts that he is in possession of the land in Survey No.328/24 of an extent of 1.83 ares by placing reliance on patta No.1518. According to the petitioner, the third respondent has unlawfully obtained patta No.1265 in respect of survey No.328/27 ad measuring 1.31 ares and that the petitioner is thereby deprived of the access to his property.

2. Learned Additional Government Pleader accepts notice for respondents 1 and 2. He invited my attention to the communication from the Tahsildar stating that a pathway would be provided to the petitioner in an area where the houses are not constructed and that the surveyor would be directed to provide such pathway.

3. In the above circumstances, this Writ Petition is disposed of by directing the second respondent to initiate further action on the petitioner's request after issuing notice to the third respondent and considering objections, if any, from the third respondent. This process 2/4

shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
