ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the respondents 1 and 2.

2.The writ petitioner got married to one Muthusamy, who is the son of the third respondent herein. Through the said marriage, two children were born. Subsequently, the matrimonial relationship came under strain and the petitioner has been residing separately along with the children. The petitioner states that her husband as well as her fatherin-law (third respondent herein) are accused in an offence under the POCSO Act, 2012. The third respondent has come out on bail. The petitioner's husband is still in Central Prison, Madurai. The petitioner apprehends that the petition mentioned property standing in the name of her husband may be alienated. She therefore wants the registering authority not to entertain any document in respect of the said property. 2/4

3.The relief sought for by the petitioner cannot be granted in writ proceedings and has to be obtained elsewhere. The petitioner states that she will move the jurisdictional Court within a period of 7 days from the date of receipt of a copy of this order. If any such petition / plaint is filed, it shall be numbered immediately. It is also open to the petitioner to seek interim relief. A suitable order shall be passed on the petitioner's application for interim relief also. The second respondent is restrained from entertaining any document in respect of the petition mentioned property for a period of five weeks from the date of receipt of a copy of this order. I make it clear that I have not gone into the merits of the matter. The matter is left to the discretion of the Court below. The rights of the parties will abide by the outcome of the proceedings to be instituted by the writ petitioner.
