ORDER

The petitioners seeks for early disposal of case in C.C.No.34 of 2020 on the file of the learned Judicial Magistrate No.II, Padmanabhapuram within the time frame.

2.The petitioners are arrayed as A1 to A3 in C.C.No.34 of 2020, for the offence under Sections 294(b), 323, 324, 506(ii) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002.

3.The learned counsel appearing for the petitioners would submit that the final report was filed in the year 2020; that the petitioners, who are aged about 57, 54 and 26 years respectively, have been facing trial in the above said case for the past five years and that the respondent Police have not taken any steps to produce the witnesses. He would further submit that unless there is a direction to the learned Magistrate to expedite the trial, the petitioners would be put to hardship. 2/5

4.The learned Additional Public Prosecutor appearing for the first respondent Police would submit that the case is now posted for examination of L.W.1 to L.W.3 on 20.11.2025 and that 13 witnesses have been cited in the final report. He would further submit that the prosecution would produce all the witnesses as and when summoned by the learned Judicial Magistrate.

5.Considering the fact that the petitioners are facing prosecution since 2020, the learned Judicial Magistrate No.II, Padmanabhapuram, is directed to dispose of the case in C.C.No.34 of 2020 within a period of one year from the date of receipt of a copy of this order. 6.With the above direction, this Criminal Original Petition is disposed of.
