Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records of impugned refused of the petitioner online application dated 30.09.2025 for issuance of temporary firecracker license by the 2nd respondent District Revenue Officer as reflected in the online status

updated in the evening on 16.10.2025 as arbitrary illegal and without jurisdiction and consequently direct the 2nd respondent to issue the fire cracker license in favour of the petitioner based on her application number TN6620250930124.

ORDER

This writ petition is filed for the following relief : "To call for the records of impugned refused of the petitioner online application dated 30.09.2025 for issuance of temporary firecracker license by the 2nd respondent District Revenue Officer as reflected in the online status updated in the evening on 16.10.2025 as arbitrary illegal and without jurisdiction and consequently direct the 2nd respondent to issue the fire cracker license in favour of the petitioner based on her application number TN6620250930124."

2. The impugned order cannot be termed as an order inasmuch as it is not been signed by the authority concerned. It is evident from the case status that is now produced before this Court by the learned Additional Government Pleader. It is also seen that originally recommendation has been made for issuance of temporary license by the Revenue Divisional Officer. However, in the order now produced by the learned Additional Government Pleader, the remark is that the Revenue Divisional Officer has not recommended for approval. This clearly shows the arbitrariness in the impugned order. That apart, the order is an unsigned non-speaking order.

3. Therefore, the impugned order is set aside and the matter is remitted back to the 2nd respondent for consideration. However, taking into note of the fact that the Diwali is around the corner, a temporary license shall be issued to the petitioner on his giving an undertaking to ensure all safety measures. The undertaking shall be given by the petitioner today (17.10.2025). On receipt of the same, the respondents are directed to issue temporary license tomorrow (18.10.2025). The

issuance of the temporary license now shall not be taken as an advantage for the license for the next year. The respondents shall not await the copy of the order as the orders are passed in the presence of the learned counsels.

4. With the above directions, this Writ Petition stands allowed. No costs. Consequently, connected Miscellaneous Petitions are closed. 17.10.2025 NCC : Yes/No Index : Yes/No Internet : Yes gbg To 1.The District Collector, Madurai District.
