Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to survey the petitioner's land comprised in survey no. 799/5 and 799/7 situating at Silukkuvarpatty village, Nilakottai taluk, Dindigul District and to fix the four boundaries of the same in accordance with law within the time stipulated by this Court.

O R D E R

By relying on patta Nos.1474 & 1473 in respect of survey Nos. 799/7 and 799/5, respectively, the petitioner had applied for a survey of the said lands. The present Writ Petition relates thereto.

2. Learned counsel for the petitioner submits that the petitioner's brother, Mr.Gunasekaran has attempted to intrude into the land. He also submits that the said Mr.Gunasekaran has no rights in relation to survey Nos.799/5 and 799/7.

3. Learned Government Advocate accepts notice for both the respondents. He submits that an inquiry would be conducted after issuing notice to the petitioner and the said Gunasekaran and that orders would be issued within three (3) months.

4. Therefore, this Writ Petition is disposed of by directing the respondents to conduct an inquiry pursuant to the petitioner's request for a survey by issuing notice to the petitioner, the said Gunasekaran and owners of relevant adjacent lands. A speaking order shall be issued 2/4

within three (3) months from the date of receipt of a copy of this order. No costs.
