Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus directing the respondents to initiate action for evicting the encroachers from Chinna Eri in Survey No.11, with an extent of 13.15.05 hectors situate at Kannakoor Village, Avudaiyarkovil Taluk, Pudukottai District and to pass such other further or other order as this Court may deem fit and proper under the circumstances of this case and thus render justice. (Order of the Court was made by S.TAMILVANAN,J) Heard the learned counsel appearing for the petitioner. 2.It is submitted that the writ petition has been filed seeking for a direction in the nature of Writ of Mandamus directing the respondents to initiate action for evicting the encroachers from Chinna https://hcservices.ecourts.gov.in/hcservices/
Eri in Survey No.11 with an extent of 13.15.05 hectors situate at Kannakoor Village, Avudaiyarkovil Taluk, Pudukottai District. 3.According to the learned counsel for the petitioner, he sent a written representation to the authorities for the said relief. However, no action was taken. Hence, the present writ petition has been filed for the aforementioned relief.
4.Having gone through the accompanying affidavit, material papers and the submissions made by the learned counsel, we find it just and reasonable to direct the respondents to consider the representation of the petitioner and pass appropriate orders according to law. 5.Accordingly, the writ petition is disposed of with a direction to the petitioner to make a representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents are directed to consider the representation of the petitioner and pass appropriate orders on merits and in accordance with law, after affording opportunity to all the parties concerned within a period of four weeks form the date of receipt of a copy of this order. No costs.
