ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.10.2025 for the offences punishable under Sections 296(b), 115(2) and 315(3) of BNS, 2023, and Section 4(1) of TNWH Act, in Crime No. 1/5

673 of 2025, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner came to the Madurai District Court for attending a hearing for Domestic Violence proceedings in D.V.C.No.123 of 2025, on 16.10.2025, before the Additional Mahila Court, Madurai. While so, the petitioner and the first accused entered into a wordy quarrel with the defacto complainant, who is the wife of the first accused and a practicing advocate at Madurai District Court and assaulted the defacto complainant and caused injuries. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution. However, he has been arrested and he is languishing in jail from 16.10.2025. He further submitted that the petitioner is a cancer patient diagnosed with renal caricoma and he is currently undergoing active treatment and continuous medication. Therefore, he prays for grant of bail. 2/5

5. The learned Additional Public Prosecutor appearing for the respondent police and the learned counsel appearing for the intervener opposed to grant bail on the ground that the petitioner had directly approached this Court, without approaching the concerned Sessions Court.

5.In view of the above, this Court is of the considered opinion is that it is settled preposition of law that High Court cannot entertain bail petition directly and the accused ought to approach the concerned Lower Court. Hence, the petitioner is hereby directed to file bail application before the learned Judicial Magistrate No.VI, Madurai, and the same shall be considered in accordance to law.

6.With the above directions, this Criminal Original Petition is disposed of.
