WP(MD)No.15496 of 2012 :- Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order of suspension in Roc.No. 7614/2011/A1 dated 25.02.2011 on the file of the Respondent and consequential order in Na.Ka.No. 7614/2011/A1 dated 22.09.2012 on the file of the Respondent and consequently direct the respondent to re instate the petitioner in his service forthwith.

JUDGMENT

(Judgment of this Court was made by M.SATHYANARAYANAN, J.) The Appellant has challenged the order of deemed suspension and subsequently, on reaching the age of superannuation, he was not permitted to retire and for continuation of departmental proceedings, he has been placed under suspension. In the light of the said development, nothing survives for adjudication in this Writ Appeal. The learned counsel appearing for the petitioner has also made an endorsement to that effect.

2. The Court heard the submission of Mr.A.K.Baskarapandian, the learned Special Government Pleader, who appears for the respondents.

3. In the light of the endorsement so made by the learned counsel for the appellant, the Writ Appeal is dismissed as withdrawn. However, the petitioner is at liberty to work out his remedy in accordance with law, if he is aggrieved by the further proceedings. No costs. Consequently, connected Miscellaneous Petition is also dismissed.
