O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the third respondent to issue patta to the petitioner in respect of the property comprised in Survey No. 92/17, to an extent of 41⁄2 cents, at Aariyapatti Village, Usilampatti Taluk, Madurai District, based on the petitioner's representation dated 28.06.2025, within a time frame.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3. The learned counsel for the petitioner submits that the subject land originally belonged to the petitioner's father and is classified as natham land. The grievance of the petitioner is that the authorities have surveyed only 3 cents out of 71⁄2 cents. Therefore, he submitted a representation dated 28.06.2025 requesting survey of the remaining portion of the property. Since the representation was not acted upon, the present writ petition has been filed.

Per contra, the learned Additional Government Pleader appearing for the respondents submits that the petitioner sought patta for an extent of 71⁄2 cents, however, patta has already been issued for 3 cents in favour of the petitioner. The remaining 41⁄2 cents was not considered for patta due to a pending civil dispute.

5. Since the civil suit in O.S. No. 430 of 2023 is pending before the Sub Court, Usilampatti, all rival contentions are to be agitated before the civil court. Therefore, the relief sought by the petitioner cannot be granted.

6. With the above obsevations, this writ petition stands disposed of. No costs.
