ORDER

This writ petition has been filed seeking the issuance of a Writ of Mandamus directing the respondent Bank to remove the name of the petitioner's wife, Lata Mageshwari, from Locker No.13, to cancel the "Either or Survivor" mode of operation in respect of the said locker, and consequently to direct the respondent Bank to issue a fresh key to the petitioner for the said locker.

2. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondent Bank, and perused the materials on record.

3. The petitioner submits that he is maintaining an account with the respondent Bank bearing Account No. 3109764145. He further states that he has hired a locker in the same branch bearing Locker No.13, which stands in the joint names of the petitioner and his wife, Lata Mageshwari. The locker rent is being paid by the petitioner. However, the mode of operation of the said locker is "Either or Survivor." The petitioner further submits that due to a matrimonial dispute, he and his wife have been living separately for the past one year. According to the petitioner, the locker key is in the custody of his wife and, therefore, he is unable to operate the locker. Claiming to be the first holder of the locker, the petitioner made a 2/4

representation to the respondent Bank seeking cancellation of the "Either or Survivor" mode of operation, removal of his wife's name from the locker, and issuance of a fresh key. As the said representation has not been considered, the present writ petition has been filed.

This Court is of the view that the relief sought by the petitioner involves disputed questions of fact arising out of a matrimonial dispute and contractual obligations, which cannot be adjudicated in a writ jurisdiction under Article 226 of the Constitution of India. Therefore, the writ petition is not maintainable. Accordingly, the writ petition stands dismissed. No costs. 07.11.2025 NCC : Yes/No Index : Yes/No Internet:Yes skn 3/4
