ORDER

This writ petition has been filed by the petitioner seeking a writ of mandamus, directing the first and second respondents to take appropriate action against the third respondent Sangam, as per Section 44(6) of the Societies Registration Act and to dissolve the Sangam.

According to the petitioner, there existed some dispute with regard to a property in T.S.No.204, North Car Street, Palani Town, Dindigul District, between the petitioner's family and the third respondent Sangam and after some rounds of litigation, the suit was decreed in favour of the Sangam. It is the contention of the petitioner that there are some malpractices in the Sangam and therefore, she has made an application under the RTI Act seeking the details of the said Sangam, whereupon, she came to know that the third respondent Sangam has not filed the returns / documents before the authorities concerned for a quite long period and action has also been initiated against them. Thereafter, the petitioner has made a representation before the authorities for dissolving the Sangam / the third respondent and because of their inaction, the present petition has been filed.

After due notice, the learned Counsel appearing for the third respondent Sangam represented before this Court that earlier there was some delay in filing the returns and subsequently, they had made a condonation petition before the authority concerned, who in turn accepted the same and permitted the third respondent Sangam to function.

4. Heard the learned Counsel for the petitioner, the learned Government Advocate appearing for the respondents 1 & 2 and the learned Counsel appearing for the third respondent.

5. Considering the facts and circumstances, this Court is of the view that nothing survives for further adjudication in this petition and the same is disposed of, leaving it open to the petitioner to approach the competent authority, for any other action, in the manner known to law. No costs. Consequently, connected miscellaneous petition is closed.
