PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondent 4 to retrieve the lands in Survey Nos.291 (part), 292, 3A, 3B, 3C, 4 and 181/5 of Poolangudi Village, Sathanur, Sivagangai District measuring 11 acres and 70 cents to Arulmigu Poovilluganda Thirukannudai Ayyanar Temple by restoring the revenue entries in the name of temple and by removing the encroachments therein within a time frame. 2/6

O R D E R
This writ petition has been filed seeking issuance of a writ of mandamus, directing the fourth respondent to retrieve the lands in Survey Nos. 291 (part), 292, 3A, 3B, 3C, 4, and 181/5 of Poolangudi Village, Sathanur, Sivagangai District, measuring 11 acres and 70 cents, in favour of Arulmigu Poovilluganda Thirukannudai Ayyanar Temple by restoring the revenue entries in the name of the temple and removing the encroachments therein within a specified time frame.
2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents. Having regard to the nature of the order proposed to be passed in this writ petition, notice to respondents 5 to 22 is dispensed with.
3. The learned counsel for the petitioner submits that the representation dated 22.08.2025, seeking retrieval, restoration and removal of encroachments pertaining to the lands in question, has not been considered till date. Hence, the petitioner was constrained to file the 3/6
present writ petition.
4. The learned Government Advocate appearing on behalf of respondents 1 to 4 submits that after considering the claims of all parties, including the newly impleaded parties, the representation of the petitioner will be considered in accordance with law.
5. In view of the above, this Court directs the fourth respondent to conduct an inquiry in relation to the petitioner's representation dated 22.08.2025, after issuing notice to the petitioner, respondents 5 to 22 and any other persons interested in the subject property, and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same may be agitated before the competent civil court. No costs.
