Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned notice in NOTICE NA.KA.No. 5350-1/2025/E3 dated 03.10.2025 issued by the third respondent and quash the same as illegal and consequently directing the 2nd and 3rd respondents herein not to execute the impugned order dated 09.09.2025 in NA.KA.No.8310/2024/E3 passed by the second respondent till the disposal of the appeal pending on the file of the first respondent based on the petitioner's representation dated 19.09.2025. ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the respondents 1 to 4.

2.The Assistant Commissioner, HR&CE Department, Madurai had issued notice dated 03.10.2025 seeking explanation with the writ petitioner as to why fit person should not be appointed for the petition 2/5

mentioned temple. Challenging the same, this writ petition has been filed.

3.It is well settled that challenge to a show cause notice should not ordinarily be entertained. The petitioner has given his objections. 4.The learned Special Government Pleader states that the third respondent before passing final order will definitely take into account the writ petitioner's objections given on 29.09.2025. If any adverse order is passed, the petitioner is very much having statutory remedy by an appeal. If necessary, even a fresh writ petition may also be filed on the same cause of action. I therefore do not find any ground to interfere at this stage.

5.This Writ Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed. 28.10.2025 NCC : Yes/No Index : Yes / No Internet : Yes/ No MGA 3/5
