The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 45 days in filing the appal against the judgment and decree, dated 12.03.2025 in A.S.No.56 of 2019 on the file of the Sub Court, Melur, confirming the judgment and decree, dated 28.08.2017 in O.S.No.72 of 2008 on the file of the District Munsif Court, Melur.
2. Heard the learned counsel for the petitioners, learned counsel for the respondents and also perused the records.
3.The learned counsel for the respondents would submit that they are leaving it to the discretion of the Court.
4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
