ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 351(3) of BNS/Corresponding offence section 506(ii) of IPC and Section 66A of IT Act, in Crime No. Not known of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The present petition is filed without crime number. The learned Government Advocate (crl. Side) appearing for the respondent police submitted that First Information Report was registered in Crime No.60 of 2025. The counter allegation that the legal wing of the Defacto complainant has preferred another complaint against a rival group and the same was not taken on file. But, based on the earlier order of this Court the said complaint also was taken on file in Tallakulam P.S. In Crime No.1041 of 2025 for the offence under Sections 351(2), 353(1)(b), 353(2) of BNS Act. Therefore, the order passed by this court is taken seriously by the respondent and they have acted as per law. The same is appreciated.

As far as the present petition is concerned the allegation against the petitioner is that he has threatened the other side over phone. 4.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

5.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioner are serious in nature.

6. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the 3/6

petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court-I, Madurai, within a period of fifteen days from the date of receipt of a copy of this order and on further conditions that:

[a] the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of one week and thereafter, as and when required for interrogation.

[c] the petitioner shall not tamper with the evidence or witness either during investigation or trial.

[d] the petitioner shall not abscond either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial 4/6

Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
