Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the third respondent to rectify the error committed in describing the usage of a property under T.S.No.16/39 of Kochadai Village, Ward No.25, Block 3, Madurai West Taluk, Madurai District by deleting the description as 'Agricultural Land' and by describing it as an 'Approach Road' in the Town Survey Land Register.

O R D E R

The petitioner owns land in T.S.No.16/2 in Kochadai Village ad measuring 3572 sq.m. With the intention of promoting housing layout, the petitioner had divided the said land into 24 plots. In relation thereto, when the petitioner had approached the Madurai Corporation for necessary approvals, the Madurai Corporation flagged the issue that the approach road in survey No.16/39 is described in the utilization column as 'Vivasaya Nilam. The present Writ Petition has been filed in those circumstances seeking disposal of the request for rectification/reclassification.

2. Learned Special Government Pleader accepts notice for respondents 1 to 3 and learned Standing Counsel accepts notice for the fourth respondent. Learned Special Government Pleader submits that the Revenue Divisional Officer would consider and dispose of the petitioner's request within six (6) weeks.

Accordingly, this Writ Petition is disposed of by directing the third respondent to consider and dispose of the petitioner's request to change the description as 'Approach road' instead of 'Agricultural land' within six (6) weeks from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and any other persons concerned. No costs.
