This Writ Petition is filed seeking a direction to the respondents 1 and 3 to give permission to the petitioner to remove the rough stones and uneven soil surface from his land in S.No.A10/83 - 1A in Vilavancode Village (Kuzhithurai Town), Vilavancode Taluk, Kanyakumari District and dump it in his other lands in S.Nos.A3/69-3, 622/6 and 622/8A2 in the same village on the basis of the recommendation of the 2nd respondent Sub Collector's in Mu.Mu.A1/8054/2022 dated 26.10.2023.

The learned counsel appearing for the petitioner would submit that the petitioner has submitted an application seeking permission to remove the rough stones and uneven soil surface from his land to his other lands for the purpose of doing agricultural activities. The second respondent has also by his proceedings dated 26.10.2023 recommended for giving permission. However, till date, no permission was granted to the petitioner. Hence, the petitioner has approached this Court.

3. The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that if the petitioner is submitted an online application, the same will be considered.

4. In reply, the learned counsel appearing for the petitioner submitted that the petitioner has also submitted an online application on 25.10.2025.

5. In the present case, the petitioner is intended to remove the rough stones and uneven soil surface from his land to his other lands for the purpose of doing agricultural activities. Though the second 3/6

respondent has recommended for giving permission, till date no permission was granted to the petitioner. I am unable to understand why the respondents are sleeping over on this aspect. Hence, this Court directs the first respondent to consider the online application of the petitioner dated 25.10.2025 and send his recommendation along with the recommendation of the second respondent dated 26.10.2023 to the third respondent and after receipt of the same, the third respondent is directed to give permission to the petitioner for removing the rough stones and uneven soil surface from his land and dumping it to his other land, within a period of one week thereafter.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
