ORDER

The review applicant asserts that the writ petitioner had suppressed material facts relating to an earlier writ petition, namely, W.P.(crl)MD)No.1405 of 2025 and the order passed there in. In addition, he further submits that the writ petitioner has only an undivided share in the relevant property and that a survey cannot be requested unless the property were to be partitioned. By the order sought to be reviewed, the Tahsildar was directed to consider objections from the 5th respondent, who is the husband of the review applicant, and not to proceed with the survey if there is a title dispute. In these circumstances, it is always open to the review applicant to raise the objections before the tahsildar. If such objections are raised, it is needless to say that the Tahsildar shall duly consider such objections as per directions already issued. A speaking order shall be issued in relation to such objections.

2. With these observations, this review application is disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 06.11.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 2/4
