Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF Mandamus directing the respondents to provide the petitioner permanent alternative employment with pay protection and continuity of service and all other attendant benefits on par with other employees, in the light of section 20 of the Rights of Persons with Disabilities Act, 2016 and on the basis of the medical board recommendations by considering the petitioner's representation dated 19.09.2025 and provide him salary for the period in which duty was not given by the respondents. 1/4

ORDER

This Writ Petition is filed to issue a WRIT OF Mandamus directing the respondents to provide the petitioner permanent alternative employment with pay protection and continuity of service and all other attendant benefits on par with other employees, in the light of section 20 of the Rights of Persons with Disabilities Act, 2016 and on the basis of the medical board recommendations by considering the petitioner's representation dated 19.09.2025 and provide him salary for the period in which duty was not given by the respondents.

2. When the matter was taken up for hearing, it has been submitted that the petitioner had been alternatively accommodated in the post of Security (Personal).

3. When the Medical Board had declared him with 60% of locomotive disability, he cannot be accommodated even in the said post and he should be accommodated in any office work suitable to his educational qualification or otherwise by an application of provisions of the Persons with Disabilities Act, a suitable post should be created and he should be placed in the said post. 2/4

4. Learned counsel for the petitioner would submit that he can also be employed as an Office Assistant in Ticket Book Loading Section as an alternative employment.

5. The petitioner shall make a representation in that regard to the first respondent and the first respondent is directed to consider the same and pass appropriate orders within a period of two weeks from the date of receipt of such representation and accommodate the petitioner in any alternative place which do not demand any physical activity.

6. With the aforesaid direction, this writ petition is disposed of. No costs.
