By relying on a sale deed dated 14.12.2009, the petitioner had applied for patta transfer. The said application was rejected by an order dated 19.07.2025, by stating that an appeal is pending before the Revenue Divisional Officer against the grant of patta to the petitioner's vendor, Chandran. After submitting further representation on 02.10.2025, the present Writ Petition has been filed.

2. Learned Special Government Pleader accepts notice for all the respondents. He points out that the petitioner was aware about the reason for rejection of his request for patta. On the basis of written instructions, he also points out that the appeal filed against the grant of patta to Chandran is at an advanced stage and that the petitioner may apply for mutation of patta if Chandran succeeds before the Revenue Divisional Officer.

3. The order of rejection dated 19.07.2025 is on record. Upon the petitioner's request being rejected, the petitioner had the option of filing 2/5

an appeal before the Revenue Divisional Officer. Instead of exercising such option, after submitting additional representations, the present Writ Petition has been filed.

4. The petitioner's entitlement for patta transfer is contingent on the validity of the patta issued to his vendor. The validity thereof is under challenge before the Revenue Divisional Officer. Learned Special Government Pleader has pointed out that such inquiry is at an advanced stage.

5. In these circumstances, the relief claimed by the petitioner cannot be granted at this juncture. Therefore, this Writ Petition is disposed of by leaving it open to the petitioner to reapply if Chandran succeeds in proceedings before the Revenue Divisional Officer. No costs.
