ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/5

for the offences punishable under Sections 316(2), 296(b) of BNS, 2023 and Sections 9, 10 of CM Act and Sections 5(1) and 6 of POCSO Act, 2012 in Crime No.17 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on the date of 19.05.2024, the defacto complainant's parents and the accused person / accused person's parents arranged the marriage without her knowledge between the defacto complainant and the accused person. In the mean time, the defacto complainant called the help line service call of 100. Thereafter, the police came to the place and stopped the marriage. On 19.05.2024 at 06.30 PM., the accused person /accused person's parents suddenly moved to Usilampatti Taluk, Arittapatti Taluk, in Kanniyampatti Village, in front of Kamatchi Amman Kovil. Both the parents forced to marry the accused namely Gowtham. After one year, they asked dowry of 100 sovereigns of golds and Rs.10 Lakh/- cash to the defacto complainant. Hence, a case has been registered against the Petitioner. 3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner. 2/5

4.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioner are serious in nature. Further, the Accused Nos.1 to 3 were taking steps to conduct marriage and there was an intimation to the Police through a service call of 100 The Police intervened and stopped the marriage but subsequently, the marriage has taken place.

5.Therefore, this Court is of the considered opinion that prima facie there is a case against the Accused Nos.1 to 3.

6.Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

7. Accordingly, this Criminal Original Petition is dismissed. 17.11.2025 TMG (2/4) 3/5
