ORDER

This Civil Revision Petition is filed challenging the order dated 16.07.2025 made in I.A.No.03 of 2024 made in H.M.O.P.No.468 of 2023 by the Family Court, Kanyakumari District at Nagercoil, where a sum of Rs.10,000/- awarded for the maintenance of the revision petitioner / husband to the wife/ respondent herein and the Court has further directed the sum of Rs.20,000/- to the litigation expenses.

Ms.Susmitha, learned counsel appearing for the revision petitioner / husband submitted that the respondent cannot claim any maintenance pendente-lite expenses, as her application do not satisfy the requirements under Section 24 of the Hindu Marriage Act. There is no basis, the respondent claim monies to the tune of Recording the above said submission of the.30,000/- per month from the revision petitioner towards care for the child. The learned counsel further submitted that he has enclosed the salary slip at page No.46 of the typed set, where the net pay drawn by the revision petitioner / husband is Rs.21,936/-. 2/5

3. The learned counsel appearing for the respondent submitted that the trial Court has passed a well-reasoned order and that no interference is warranted.

4. Heard the learned counsel on either side and perused the material available on record.

5. It is seen that the trial Court has awarded a sum of Rs.10,000/- towards monthly maintenance for the wife and the female infant child. In such circumstances, the order passed by the trial Court with regard to the monthly maintenance warrants no interference.

4. However, the trial Court directed the revision petitioner to pay a sum of Rs.20,000/- towards litigation expenses. The said direction is hereby set aside and the Civil Revision Petition is allowed to that extent. 3/5

5. The respondent / wife is permitted to withdraw the amount, which is deposited by the revision petitioner, before the trial Court. No costs. Consequently, connected Miscellaneous Petition is closed. 17.02.2026 LS TO 1.The Family Court, Kanayakumari District at Nagercoil.
