The above petition has been filed seeking orders to condone the delay of 87 days in filing a petition to set aside the order of dismissal of the second appeal against the respondent on 30.06.2025 in SA(MD)No.235 of 2024 along with CMP(MD)No.4601 of 2024.

2. Despite receipt of notice sent through Court and privately, the respondent has not turned up.

3. Heard the learned counsel appearing for the petitioners.

4. Considering the reasons assigned and also the quantum of delay, this Court is inclined to condone the delay.

Accordingly, this petition is ordered. The Registry is directed to take the petition to set aside the order of dismissal on file, if it is otherwise in order and after numbering, issue notice to the respondent returnable by 13.02.2026. Private notice is also permitted.
