ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus directing the 2nd respondent to implement the order passed by the 1st respondent in proceedings No. THA.Pa/05/2023/A3 dated 02.06.2023, issued under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

2. The petitioner is a senior citizen aged about 70 years. She executed a settlement deed in favour of her daughter in recognition of the unwavering care and support extended by her. The 3rd respondent, who is the petitioner's son, despite being financially well-off and capable of providing maintenance and care, has neglected his filial responsibilities and has shown no concern for the petitioner's welfare. Consequently, she has been entirely dependent on her daughter. After execution of the settlement deed, the 3rd respondent allegedly locked the house property and took away the keys, thereby denying the petitioner access to her own property. Hence, the 2/5

petitioner approached the 1st respondent by filing a complaint under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

By order dated 02.06.2023, the 1st respondent directed the 3rd respondent to hand over the keys of the property to the petitioner and instructed the 2nd respondent-Police to take necessary steps to enforce the said order. As no action was taken, the petitioner submitted representations dated 31.07.2025 and 18.08.2025 to the respondents. However, no further action ensued, prompting the petitioner to file the present writ petition.

4. When the matter was taken up for hearing today, it was submitted that the property in question has been handed over to the petitioner and that the police authorities have rendered necessary assistance. The petitioner is now in possession of the property.

5. In view of the above submission, this writ petition is closed. No costs.
