PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent to survey and fix the boundaries for the purpose of fencing the area in S.No.56/3 situates in Puliyampatti, Palani Taluk, Dindigul District based on the challan dated 31.03.2024.

ORDER

By relying on settlement deeds dated 16.11.2011, 11.08.2023 and 08.12.2023 and pattas in the name of the petitioner and her son, the petitioner 1/4

had applied for a survey of the land on 31.03.2024. The present writ petition relates thereto.

2. Learned counsel for the petitioner, on instructions, submits that there is no title dispute relating to the property. He also submits that action has not been taken on the request for survey in spite of the lapse of a long period of time.

3. Learned Special Government Pleader accepts notice for both the respondents. He submits that action would be initiated on the petitioner's application and necessary measures would be taken within three months from the date of receipt of a copy of this order.

4. The learned counsel for the petitioner placed on record both title and the revenue records relating to the property. Patta No.1858 in respect of S.No. 56/3A stands in the name of the petitioner and patta No.2100 in respect to S.No. 56/3B stands in the name of the petitioner's son. It has been stated that there is no rival title claim.

5.In the above circumstances, this writ petition is disposed of by directing the respondents to initiate action on the petitioner's request for survey after issuing notice to owners of relevant adjacent lands and considering objections, 2/4
