ORDER

This Civil Miscellaneous Petition has been filed seeking permission for the petitioner to withdraw a sum of Rs.14,07,654/- deposited by the respondent before the Motor Accident Claims Tribunal / Additional District Judge, Karur, in M.C.O.P.No.313 of 2020.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The learned counsel for the respondent submitted that 50% of the deposited amount may be permitted to be withdrawn by the petitioner.

4. Considering the facts and circumstances of the case and being satisfied with the reasons stated in the affidavit, this Court is inclined to allow this petition.

5. Accordingly, this Civil Miscellaneous Petition is allowed. The petitioner is permitted to withdraw 50% of the deposited amount in 2/4

M.C.O.P.No.313 of 2020, along with proportionate interest and costs, by filing necessary application before the Motor Accident Claims Tribunal / Additional District Judge, Karur.
