ORDER

This writ petition has been filed seeking a Writ of Mandamus to direct the respondents 1 to 5 to immediately implement the order dated 27.10.2020 passed by the 4th respondent in Proceedings No. Pa.Mu.A2/2797/2019, by restoring the petitioner to peaceful possession and enjoyment of her self-acquired residential house and by securing the return of her property documents and identity cards from the 6th respondent, after considering her representation dated 25.08.2025 within a time frame to be fixed by this Court.

2. The petitioner is a 70-year-old senior citizen. She complained that in 2019, her younger daughter (the 6th respondent) forcefully evicted her from her own self-acquired house and kept all her property documents and identity cards. The petitioner approached the Maintenance Tribunal (4th respondent), which passed an order on 27.10.2020 directing the 6th respondent to allow the petitioner back into her house and return her documents. However, even after four years, the order was not implemented. 2/5

The petitioner then gave a representation on 25.08.2025 to the authorities / the respondents 1 and 5, but no action was taken. Therefore, she filed this writ petition seeking a direction to enforce the Tribunal's order and restore her rights.

2. During the hearing, it was informed that the petitioner has now been restored to her house. However, her documents such as property papers, PAN card, Aadhaar card, etc., have still not been returned.

3. Since the petitioner has already been allowed back into her house but her documents are still missing, the Court directs the police to register a case regarding the missing/withheld documents, and Investigate the matter and take necessary action as per law.
