ORDER

The petitioner seeks for early disposal of case in S.C.No.181 of 2021 on the file of the Additional District Court, Kumbakonam. 1/4

2.The petitioner is arrayed as A21 in S.C.No.181 of 2021, for the offence under Sections 147, 148 and 294(b) of IPC r/w Section 3(1) of TNPPDL Act.

3.The learned counsel appearing for the petitioners would submit that the final report was filed in the year 2021 and the petitioner, who is aged about 55, has been facing trial in the above said case for the past four years; that the respondent Police have not taken any steps to produce the witnesses; and that unless there is a direction to the learned Magistrate to expedite the trial, the petitioner would be put to irreparable loss and hardship.

4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the trial has not commenced since some of the accused are absconding and NBW is pending against them. 5.The learned Additional District Judge, Kumbakonam may ensure the execution of warrant against some of the accused at the earliest. If those accused are unable to be secured within a reasonable time, the 2/4

learned Additional District Judge may split up the case against the petitioner and conclude the trial against him as expeditiously as possible. 6.With the above observation, this Criminal Original Petition is disposed of.
