O R D E R
The relief sought for in this Writ Petition is to direct the second respondent promote the Petitioner to the post of Deputy Registrar of Co-operative Societies from the date of his immediate juniors were promoted.
2.The promotion can never be claimed as a matter of right. However, consideration for promotion is the right of an employee. Thus all the eligible persons are to be considered while undertaking the process of promotion.
https://hcservices.ecourts.gov.in/hcservices/ 3.The grievance of the Writ Petitioner is that he is eligible for promotion to the post of Deputy Registrar of Co-operative
Societies on par with his juniors. However, his case was not considered. In this regard, the Writ Petitioner has submitted a representation dated 20.1.2011 and the same has not been disposed of. The Writ Petitioner is now retired from service. However, his case may be considered on merits.
4.In this view of the matter, without going into the merits of the matter, the second respondent is directed to consider the representation submitted by the Petitioner on 20.1.2011 and pass orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. The Writ Petitioner is directed to enclose a copy of the representation and the relevant documents, if any, along with a copy of this order to the second respondent, for further action.
5.Accordingly, the Writ Petition stands disposed of. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
