PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order dated 31.07.2025 passed by the second respondent in No. (Pa.Mu.)Aa3/7032/2024 and quash the same and consequently, direct the third respondent to restore the individual separate patta granted to the petitioner on 05.09.2020 for 20 cents in Survey No. 455/9A2 in Aloor.A Village, Kalkulam Taluk, For Petitioner : Mr. M.S.Suresh Kumar For Respondents : Mr.P.Thambidurai Government Advocate for R1 to R4

O R D E R

The petitioner assails an order dated 31.07.2025 of the Revenue Divisional Officer. Learned counsel for the petitioner concedes that a revision petition had been filed against the said order and that the said revision petition is pending as on date.

2. Learned Government Advocate accepts notice for respondents 1 to 4. He submits that the pending revision petition would be disposed of on merits within three (3) months from the date of receipt of a copy of this order, after providing a reasonable opportunity to all concerned. 2/5

In view of the petitioner having availed of the alternative statutory remedy under the Tamil Nadu Patta Passbook Act, 1983, I am not inclined to exercise discretionary jurisdiction by considering the challenge to the order of the Revenue Divisional Officer. Instead, this Writ Petition is disposed of on the following terms: i. The District Revenue Officer is directed to consider and dispose of the petitioner's stay petition within fifteen (15) days from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and the private respondents. ii. The District Revenue Officer is further directed to consider and dispose of the revision petition on merits within three (3) months from the date of receipt of a copy of this order, after providing a reasonable opportunity to all parties thereto. iii. No costs. Consequently, connected miscellaneous petitions are closed.
