Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to disburse the petitioner balance retirement benefits of Rs.3,08,480/- payable to petitioner by the 3rd and 4th respondents within time stipulated by this Honble Court and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

This writ petition is filed seeking direction to the respondents to disburse the petitioner balance retirement benefits of Rs.3,08,480/- payable to petitioner by the 3rd and 4th respondents.

2. I have carefully considered the submissions made on either side and perused the materials available on record. 2/6

3. The petitioner who had been appointed as a Secretary in the 3rd respondent Society had been transferred to the 4th respondent Society and thereafter he had also been superannuated on 31.01.2024. The 3rd respondent being administrator of the Society is liable to be disburse the terminal benefits and the 4th respondent is liable to pay the gratuity amount. Even according to the 3rd respondent, as of now the liability of the 4th respondent to pay gratuity is only for a sum of Rs.1,74,786/-

4. It is the case of the fourth respondent that the third respondent has already made the payment, and the dispute between the third and fourth respondents does not affect the petitioner's terminal benefits.

5. In such view of the matter, the 3rd respondent is directed to make necessary payment of balance amount of terminal benefits to which the petitioner is entitled to within a period of twelve weeks from the date of receipt of a copy of this order. It is open to the 3rd respondent to recover the amount payable by the 4th respondent to the credit of the petitioner along with statutory interest.

6. This writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed. 19.11.2025 Index : Yes/No Speaking/Non-Speaking order gvn 4/6
